Ukrainian Parliament votes in favour of reinstatement of Judge Oleksandr Volkov

A decisive vote taken by the Ukrainian parliament on 25 December 2014 marks a significant step towards the reinstatement of Oleksandr Volkov to his position as a Supreme Court judge, as required by the European Court of Human Rights.

The Verkhovna Rada voted (by a majority of 257) to overturn its resolution of 17 January 2010 concerning Volkov’s dismissal. On 9 January 2013, the European Court (ECtHR) had delivered judgment in the case of Volkov v Ukraine (No. 21722/11), finding that his dismissal violated his right to a fair trial, and ruling that the authorities should “secure the applicant’s reinstatement in the post of judge of the Supreme Court at the earliest possible date”.

It is expected that this vote will shortly be followed by a decision of the Supreme Court formally reinstating Mr Volkov.

Mr. Volkov was represented at the ECtHR by EHRAC’s lawyers. The implementation of his judgment has been actively supported by the Law Society of England and Wales, and Judges for Judges.
