Russian Constitutional Court: European Court judgements are ‘newly discovered circumstances’ in civil cases


Until recently, the Russian Constitutional Courts had not considered the finding of violations in the ECtHR as grounds for reconsidering a civil case. In February 2010, in the light of complaints from three Russian nationals, this legislation was revised to allow cases to be reconsidered due to ‘newly discovered circumstances’.
