The applicants, Arayik Zalyan, Razmik Sargsyan and Musa Serobyan, were former servicemen in the Armenian army. They alleged that they had been subjected to torture in violation of Art. 3 ECHR in April 2004, while detained as suspects for the murder of two servicemen in their military unit, and that there was no effective investigation into their allegations of ill-treatment. Mr Zalyan also alleged that he had been unlawfully deprived of his liberty in violation of Art. 5 ECHR. On 18 May 2005, the Syunik Regional Court found the applicants guilty of murder and sentenced them to 15 years’ imprisonment. Following a number of appeals, the Court of Cassation quashed the findings of guilt and remitted the case for further investigation. On 18 December 2012, the Shirak Regional Court found that the guilty verdict had not been substantiated and acquitted the applicants.
