At a Ukrainian Independence Day ceremony in 2011, the Ukrainian President Yanukovych laid a wreath at a monument to a famous Ukrainian poet and public figure. The applicant was taking part in a public gathering, organised by the opposition party, Batkivshchyna. She removed the wreath’s ribbon containing the words “the President of Ukraine V.F. Yanukovych”, because she believed he should not hold this position. A police officer filmed her action and reported it to his superiors.

The applicant was taken to a district police station and charged with “petty hooliganism”. She was not allowed to see a lawyer, and refused to sign the police report. She was convicted and sentenced to 10 days’ administrative detention. Her appeal was denied after she had served her sentence.
