REUTERS\/Maxim Shemetov<\/p><\/div>\n<p><a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-167944\">LGBTI activists and supporters organised a kissing protest outside the Duma<\/a>\u00a0(Russian parliament) in Moscow on the day a bill proposing the prohibition of \u2018propaganda of non-traditional sexual relations\u2019 was having its second and third reading. The protesters (including five applicants in this case) were far outnumbered by conservative Orthodox Christian activists who supported the bill. They threw rotten eggs and nettles at the protesters. Shortly after this police officers surrounded the LGBTI activists and pushed them into police buses. Around 60% of the protesters against the bill were arrested, detained and charged, compared with only 2% of the Orthodox activists.<\/p>\n<p>The applicants complain of an infringement of their right to freedom of assembly (Article 11 of the European Convention on Human Rights (ECHR)), and the prohibition of discrimination on grounds of sexual orientation and political opinion with regards to their arrest (Article 14). In\u00a0<a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-167640\"><em>Andreyeva and others v Russia<\/em><\/a><em>,\u00a0<\/em>the ten applicants were denied entry to the court house, and they had no option but to assemble outside the court building. The ten applicants in\u00a0<a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-167939\"><em>Mayzuls and others v Russia<\/em><\/a>\u00a0joined the same assembly. Along with other members of the public, the assembly started chanting\u00a0<em>\u201cFreedom for the 6 May prisoners\u201d<\/em>,\u00a0<em>\u201cFreedom for political prisoners\u201d<\/em>\u00a0and\u00a0<em>\u201cRussia without Putin\u201d<\/em>. The police authorities deemed this to be an unauthorised protest and ordered them to disperse. All the applicants were arrested, and convicted of administrative offences. A similar case pursued by EHRAC and Memorial, involving a protest on 21 February 2014, is now being considered by the Court following its\u00a0<a href=\"https:\/\/ehrac.wpengine.com\/news\/european-court-questions-russias-handling-of-bolotnaya-square-demonstration-hearings\/\">communication to Russia in June 2016<\/a>.<\/p>\n<p>The applicants in both cases argue that their protest was spontaneous, and therefore they could not have sought prior authorisation. They also argue that the authorities\u2019 decision to disperse the protest and arrest the applicants was disproportionate, in breach of Article 11 ECHR. They complain that their arrests were arbitrary and, ten of the applicants argue that their detentions were unlawful (Article 5 ECHR), and that they were denied a fair trial (Article 6 ECHR). The applicants in\u00a0<em>Andreyeva<\/em>\u00a0also complain of an infringement to their right not to be punished twice (double jeopardy), under Article 4 of Protocol 7 ECHR.<\/p>\n<hr \/>\n<h3 style=\"text-align: center;\"><em>2 March 2014:\u00a0<\/em><em>Manezhnaya Square protest against Russia\u2019s military intervention in Ukraine<\/em><\/h3>\n<hr \/>\n<div class=\"primary\">\n<p>On 1 March 2014, the Upper House of the Duma approved a presidential request to use armed forces in Ukraine. The next day, around 300 protesters (including the 14 applicants) gathered on Manezhnaya Square, silently holding homemade posters saying\u00a0<em>\u201cNo to war\u201d<\/em>\u00a0and\u00a0<em>\u201cNo to intervention in Crimea\u201d<\/em>, as well as white paper doves. Protesters later started chanting \u201cNo to war\u201d at which point the police began to make arrests: around 100 people were apprehended in total, according to the Russian Ombudsman\u2019s representative.
