The implications of the Grand Chamber judgment for the protection of liberty in international armed conflicts
In September 2014, the Grand Chamber of the European Court of Human Rights (‘ECtHR’) delivered its judgment in the case of Hassan v UK. The judgment is the first time that the ECtHR has expressly stated its views on the interaction between international humanitarian law and the European Convention on Human Rights. The ECtHR focused on the right to liberty in the context of international armed conflicts, and the judgment has consequences for the legal regime applicable to the deprivation of liberty in conflict situations.
