As EHRAC Director Philip Leach explains:<\/p>\n<blockquote><p>\n<em>Since we\u2019ve started, we\u2019ve successfully\u00a0<\/em><a href=\"https:\/\/ehrac.wpengine.com\/about-our-work\/human-rights-litigation\/cases\/\"><em>litigated 100 cases to judgment<\/em><\/a><em>\u00a0in Strasbourg and we have more than 200 other cases pending, and an ever increasing caseload because of cases from Ukraine, but also other cases from Russia and the South Caucasus states.<\/em>\n<\/p><\/blockquote>\n<p><a href=\"http:\/\/ehrac.org.uk\/wp-content\/uploads\/2021\/03\/EHRAC-stats.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-2382\" src=\"http:\/\/ehrac.org.uk\/wp-content\/uploads\/2021\/03\/EHRAC-stats-270x300.png\" alt=\"\" width=\"350\" height=\"389\" srcset=\"http:\/\/ehrac.org.uk\/wp-content\/uploads\/2021\/03\/EHRAC-stats-270x300.png 270w, http:\/\/ehrac.org.uk\/wp-content\/uploads\/2021\/03\/EHRAC-stats-11x12.png 11w, http:\/\/ehrac.org.uk\/wp-content\/uploads\/2021\/03\/EHRAC-stats.png 506w\" sizes=\"auto, (max-width: 350px) 100vw, 350px\" \/><\/a>This year the LSDP focused on the implementation of European Court judgments, which presents considerable challenges in the countries\u00a0concerned, as well as procedural aspects of lodging a case. Participants met with senior officials from across the various bodies of the CoE, including the\u00a0<a href=\"http:\/\/assembly.coe.int\/nw\/Home-EN.asp\">Parliamentary Assembly<\/a>\u00a0(PACE), the\u00a0<a href=\"http:\/\/www.coe.int\/t\/cm\/aboutCM_en.asp\">Committee of Ministers<\/a>, European Court Judges and Registry Lawyers.<\/p>\n<p>Ganna Yudkivska, the Ukrainian Judge at the European Court, interviewed in the video, explains that she was herself a member of various NGOs, and so fully understands the importance of meeting NGO representatives and lawyers, who will raise certain issues on behalf of victims of human rights violations. Although our participating lawyers from Ukraine are well acquainted with Ms. Yudkivska, they found that meeting with her at the Court was an opportunity to ask for advice on specific issues.<\/p>\n<p>During the LSDP, the participants attended a Grand Chamber hearing in the case of\u00a0<a href=\"http:\/\/www.echr.coe.int\/Pages\/home.aspx?p=hearings\"><em>A.B. v Switzerland<\/em><\/a>, which concerned the conviction of a journalist for disclosing confidential information from a judicial investigation. The hearing allowed participants to observe different advocacy styles, and provoked discussion about the presentation of the case. One participant, Sergey Zayets from the\u00a0<a href=\"http:\/\/rchr.org.ua\/index.php\/uk\/\">Regional Centre for Human Rights<\/a>, commented:<\/p>\n<hr \/>\n<blockquote>\n<p style=\"text-align: center;\"><em>However experienced you are, the first time you attend a hearing at the European Court, you are in awe at being there, impressed by the silence as the judges enter, and the general solemnity of the proceedings. The second time, you are able to concentrate more and listen to the content of the case. This was my third visit and only now was I able to analyse the pleading as a professional and put myself in the shoes of the lawyers. I now feel more prepared, were I to plead my own case in Strasbourg. I would not feel intimidated during the hearing, would be able to use the right tone and speak with confidence to the judges.<\/em><\/p>\n<\/blockquote>\n<hr \/>\n<p><a href=\"https:\/\/ehrac.wpengine.com\/about-our-work\/building-capacity\/\">Building the capacity of our partner NGOs<\/a>\u00a0has always been a core part of how we operate. We work closely on applications to the European Court, discussing each case\u2019s strategic value and constructing the legal argumentation. We then advise on draft applications and provide further advice and guidance at all stages of the case. Keti Shubashvili, a lawyer at the\u00a0<a href=\"http:\/\/gyla.ge\/\">Georgian Young Lawyers Association<\/a>, has been working with EHRAC for a number of years:\u00a0<em>\u201cIt always seems like there are up to fifty lawyers [at EHRAC], because they are always helpful and help us with certain legal issues.\u201d<\/em>\u00a0We have recently started working with the\u00a0<a href=\"http:\/\/www.helsinki.org.ua\/\">Ukrainian Helsinki Human Rights Union<\/a>\u00a0(UHHRU), focusing in particular on cases arising out of the conflict in eastern Ukraine. Oleg Veremenko, who is working on UHHRU\u2019s Prisoners of War project, told us:<\/p>\n<blockquote><p>\n<em>It is very important to build bridges between people, it is very important that we understand each other, and this way we can help our clients\u2026Now we can do our work with more understanding\u2026 and we are more sophisticated, more experienced and have more knowledge. So we can do it much more easily than we did before.<\/em>\n<\/p><\/blockquote>\n<p>During the LSDP, we organised a meeting with Grigory Dikov, a former European Court Registry lawyer who is now working at the\u00a0<a href=\"http:\/\/www.venice.coe.int\/\">Venice Commission<\/a>. He explained the value of meetings such as this,\u00a0<em>\u201cThe Venice Commission is doing constitutional law. We are lawyers, and we prefer meeting lawyers.\u201d<\/em>\u00a0 Judge Yudkivska also highlighted how these meetings can be beneficial.\u00a0<em>\u201cIt helps us to raise the problem, to show the problem from different perspectives, and to issue a judgment which is extremely valuable for the relevant state and relevant society.\u201d<\/em><\/p>\n<p>Challenging impunity for human rights violations does not end when a judgment is issued. We also recognise that following\u00a0through on the cases is important.\u00a0<a href=\"https:\/\/ehrac.wpengine.com\/about-our-work\/human-rights-litigation\/implementation\/\">We take steps<\/a>\u00a0to ensure that governments take the measures that they need to. to make sure that these violations do not take place again. As Frank Power, from the Permanent Representation of Ireland to the CoE, explained:<\/p>\n<hr \/>\n<blockquote>\n<p style=\"text-align: center;\"><em>It is often said in the Committee of Ministers that without implementation a judgment of the Court is just a piece of paper. It\u2019s really the implementation that gives force to it\u2026In our experience, EHRAC works as a kind of link to national NGOs. Ireland has a very positive experience of working with EHRAC in relation to certain cases at implementation stage in the context of the execution of judgments debates at the Committee of Ministers.<\/em><\/p>\n<\/blockquote>\n<hr \/>\n<p>Most recently, the\u00a0<a href=\"https:\/\/ehrac.wpengine.com\/news\/council-of-europe-launches-project-to-strengthen-judicial-accountability-in-ukraine\/\">CoE launched a project<\/a>\u00a0on\u00a0<em>\u201cStrengthening the independence, efficiency and professionalism of the judiciary in Ukraine\u201d<\/em>, making specific reference to the execution of the judgment in\u00a0<a href=\"https:\/\/ehrac.wpengine.com\/news\/oleksandr-volkov-reinstated-as-supreme-court-judge-in-ukraine\/\"><em>Volkov v Ukraine<\/em><\/a>, in which Judge Oleksandr Volkov was unfairly dismissed from the Supreme Court of Ukraine. Mr. Volkov was represented by EHRAC in his case before the European Court, which issued a\u00a0<a href=\"http:\/\/goo.gl\/IQKfIf\">landmark judgment ordering his reinstatement<\/a>.<\/p>\n<p>Moreover, we have been exploring other international mechanisms which can contribute to long-term systemic change. In April 2015, we piloted our first webinar on\u00a0<a href=\"https:\/\/ehrac.wpengine.com\/news\/ehrac-launches-webinar-series\/\">Protecting Women\u2019s Human Rights<\/a>, focusing on using UN mechanisms including the\u00a0<a href=\"http:\/\/www.ohchr.org\/en\/hrbodies\/cedaw\/pages\/cedawindex.aspx\">Committee on the Elimination of Discrimination Against Women<\/a>\u00a0and the\u00a0<a href=\"http:\/\/www.ohchr.org\/EN\/Issues\/Women\/SRWomen\/Pages\/SRWomenIndex.aspx\">Special Rapporteur on Violence Against Women<\/a>. Keti also attended the webinar:\u00a0<em>\u201c[EHRAC guidance] has provided us with several international instruments other than the European Convention, so we can substantiate our requirements in a better way.\u201d<\/em><\/p>\n<p>Professor Leach co-founded EHRAC in 2003, with the\u00a0<a href=\"https:\/\/ehrac.wpengine.com\/about-our-work\/\">vision<\/a>\u00a0that every person in the former Soviet Union has a voice, access to justice, and can hold their state to account over human rights violations.
