The applicant was represented by Ms T. Drobnjak, a lawyer practising in Belgrade.<\/em><\/p>\n

The applicant is an NGO based in Belgrade\u00a0which monitors the implementation of transitional\u00a0laws and their compliance with human\u00a0rights. In 2005, it made a request under the \u00a0Freedom of Information Act 2004 for the\u00a0Serbian Intelligence Agency (IA) to disclose\u00a0the number of people subjected to electronic\u00a0surveillance by that agency throughout the\u00a0year. Relying on a caveat in the 2004 Act,\u00a0the IA refused the request on the basis that\u00a0the information \u201ccould seriously undermine\u00a0a legitimate interest which has priority over\u00a0freedom of information.\u201d However, the Information\u00a0Commissioner (the body set up under\u00a0the 2004 Act to resolve disputes) decided that\u00a0the IA\u2019s refusal was in breach of the law and\u00a0ordered disclosure of the information within 3\u00a0days. Almost 3 years later, the IA notified the\u00a0applicant that it did not hold the information\u00a0requested.<\/p>\n
